Why You Need Unfair Dismissal Advice

General No Comments »

We all need unfair dismissal advice at one point or another.Who has not been in a job that we just don’t like. It is rare that anyone’s career goes by without coming across an unreasonable boss or unfair workplace, but the truth is that most of just quit and move on when the going gets tough. But, you should know that there are laws to protect you if you feel that you are being treated unfairly, and you should always be made aware of where to get unfair dismissal advice.

The facts behing Unfair Dismissal Advice

Unfortunately, the worst place to get Unfair Dismissal Advice is from your company’s human resources or personnel office. They are not on your side! They are working on behalf of the company and although they may be legally required to give you documents that you request, they will not fight for you. You need to go outside of the company for assistance.

Unfair Dismissal

Before you get yourself in a position where you actually need unfair dismissal advice, you should try and tackle the issues you are having at work – if you can. Here are a few keys to get you past the tough times and maybe turn the tables on your employer:

1. The problem that you are having at work must be addressed. If you feel threatened or suspect that you might be fired if you bring up a problem, then you are indeed working in a hostile work environment. This needs to be documented to the fullest, because you may be required to provide dates, times, and witnesses of events in the future.

2. If you can deal with the problem, do so in a confident and non-confrontational way. If your boss has a personal problem with you, rather than ask them why they are so angry with you all the time, ask them what you can do to make them more pleased with your performance. You may feel ridiculous doing this and even somewhat embarrassed, but if it saves your job and makes you feel better in the long run, then it is worth it.

3. Believe it or not, sometimes it is you who is the problem – and not your job or your boss. If you have time off accrued, then take a few days and see how you feel about things. If you return to work with a feeling of dread, then you really need to do something about it. But, you may find out that after just a few days’ worth of rest, all of your problems are solved.

Unfair Dismissal Advice Summary

Unfair Dismissal Advice can be found from various sources, but before they talk to you, you should have all of your evidence documented. The more evidence you have of unfair treatment, discrimination, or illegal activities, the more likely you will be to find someone to help you. There are many attorneys and employee advocates that specialize in this part of the law and can give you advice both before and after you are terminated. Just remember that no one deserves to be treated poorly at work and that a hostile work environment is good for no one.

Making Hostile Work Environment Laws Work for You

General No Comments »

No one plans on working for a company that has a hostile work environment. There was a time when most people took a job out of high school or college and fully expected to stay in that job for the rest of their life. We all know that those days are over and the average American will go through over a dozen jobs and at least two different career changes during their adult life. What this means to an employee is that they are faced with a variety of people with their own way of working, their own personal problems, and sometimes a great deal of unpleasantness. Hostile Work Environment laws are there to protect you from some unscrupulous bosses (and co-workers), and you need to be aware of what your rights are.

When people think enacting Hostile Work Environment laws to work on their behalf, they usually think of them only in terms of sexual harassment, but that is only one type of harassment. In fact, most people in the work place are subject to a Hostile Work Environment that doesn’t necessarily include any sexual connotations.

The facts about dealing with a Hostile Work Environment

For instance, we have all had a boss who, for one reason or another, didn’t like us. Maybe it was our hair color or the type of sandwich that we brought for lunch each day. It doesn’t really matter the reason, but if you are targeted by a boss and you find your work environment to be indeed hostile – which means that you are either being forced to quit or are being threatened with termination – then you need to learn about the hostile work environment laws that are out there to protect you.

hostile work environment

No one deserves to be picked on at work, made to feel unworthy, or treated differently than any other person. You should not be intimidated, frightened, or feel threatened in any way. If you do, then you are working in a hostile situation.

Of course, there is also the issue of sexual harassment. Most people think of this in terms of a male boss “hitting on” a female employee, but it can be so much more than that. “Quid pro quo” harassment is when your success in your job is determined by how much you give in to the harasser. It may not be a blatant exchange of sexual favors for a raise – it could just be putting up with his behavior in exchange for not getting fired.

Hostile Work Environment Summary

With all types of harassment, FMLA Laws require that you document every instance of harassment – the date, the time, the place, and the witnesses – in order to state your case in the future. It is rare that these types of cases actually go to court because it is much cheaper (and less shameful) for a company to pay off an employee than to go through the entire legal process, defending the harasser. But, the more information you have on your side, the stronger your case will be when you present it to the powers that be.

No one should ever tolerate harassment in the work place, and if you are feeling that you are working in a hostile environment, then do something about it.

Know Your Rights Under the FMLA Laws

General No Comments »

When people first hear about the FMLA laws, or Family Medical Leave Act, they naturally assume that it applies to women who become pregnant and need time off from work, but there is much more to this law than just that! Many employees, both men and women will find themselves taking advantage of this change in the law when they or someone in their family becomes ill.

Of course, this law was intended to protect the jobs of women who became pregnant, but we all benefit from it, too. It requires that any company of 50 or more employees (and all government agencies) give an employee up to 12 weeks’ worth of unpaid leave during any calendar year because of illness or injury. The illness does not have to be with the employee – it can be a family member as long as they are responsible for taking care of them.

Facts about FMLA Laws

FMLA Laws are in place to protect your job if you need to take an extended leave. You will not be paid during this period of time, and your employer has no obligation to continue your FMLA Benefits, but you will be guaranteed your same job at the same rate of pay when you return. For women who are pregnant, this is a guarantee of employment after a maximum of 12 weeks. For people who have to take time off to care for others (and this certainly includes men who are taking time off to take care of their wife and newborn baby), they are protected as well. In addition, employees who are seeking help for substance abuse or require psychiatric hospitalization are also covered by this law.

FMLA laws, however, are not always respected by all companies, so many people find that they have to fight for their jobs upon their return, or find that their job has been eliminated. This is illegal and you have a right to file a suit against your employer should this happen. However, in order to do this, make sure that you have all of your paperwork that was processed before you left, stating when and why you left work and that your employer agreed to cover you under the FMLA laws.

FMLA Laws Summary

Most small companies of 50 or fewer employees are under no obligation to provide this kind of unpaid leave for their employees, but more companies are starting to do this. It is a service to their employees, and it is also good for the company. By having happy employees who are able to take time off to address personal issues and then return to work, they avoid having to hire and re-train a new employee.

If you feel that you were unfairly dismissed after taking time off from work for your illness or that of a family member, then you should look into the federal FMLA Laws to see if you can seek redress. In many cases, people have been awarded settlements based on the fact that they were unfairly dismissed after such an absence.

What You Should Know About Your FMLA Benefits

General No Comments »

FMLA Benefits apply to companies with 50 employees or more, all public agencies, and all public and private elementary and secondary schools.

Facts about FMLA Benefits

To be eligible for these benefits you must have been at your job for at least 12 months and worked at least 1,250 hours over the past 12 months. If your employer has fewer than 50 employees within 75 miles of where you work, you are out of luck. The law does not apply to you. The rules for military families were updated in 2009.

FMLA Laws help families in case of emergencies and when they need some time to help balance work and family obligations. FMLA Benefits allow an employee to take an unpaid leave of absence from their job while maintaining their medical benefits. This does not mean you can take your family on a trip around the world and expect your job to be waiting for you. It won’t be unless you are irreplaceable. It does mean if you have a child you can take almost 3 months to bond with that child and nurture them until you are both ready to deal with the stress of separation while you go back to work. This unpaid leave benefit extends to mothers and fathers of newborns and newly adopted or newly placed foster children.

You may also take FMLA Benefits if you suffer from a serious medical condition which makes it impossible for you to work of if you have to care for a sick spouse, child or parent. Not all employers are happy about being forced to provide these benefits. For some companies it becomes very difficult to find short term replacements for highly specialized workers. Don’t expect to find your same job waiting for you. The law does not demand that.

Not all such leaves run smoothly. You may encounter problems when you try to return to work after taking advantage of your FMLA Benefits and not be happy with your new placement. If you know an unpaid leave is in your future because you are expecting a child, work with your employer before the time arrives. Work out the details of how your absence will be dealt with and how your return will be handled. If you value your job, don’t just go off to the hospital and then call your employer saying, “I won’t be in to work for the next 12 weeks.”

FMLA Benefits Summary

If you did everything you could to make the transition smooth or the absence is due to an unforeseen emergency, you can find help from attorneys handling employment law. An online resource you may want to consider is the site Undercover Lawyer where you will find help addressing the needs of the employee rather than the employer. Many attorneys specializing in employment law are used to representing companies since it is the large corporations that deal with these issues on a regular basis. That website looks at FMLA benefits and other employee issues from your point of view.

Unfair Employment Dismissal: It Happens to the Best of Us

General No Comments »

Not a lot of people will talk about unfair employment dismissal, but most of us have been fired at one time or another. Sometimes it is for a mighty good reason, but other times it is unreasonable and unwarranted. This type of Unfair Employment Dismissal is the kind of thing that takes away not only a family’s paycheck but a person’s self-esteem as well. In addition, it creates a permanent black mark on their employment record that can sometimes take years to overcome.

Facts about Unfair Employment Dismissal

You may think that you are alone because you don’t know anyone who has been subject to Unfair Dismissal, but you do. Your neighbor who said he was “laid off”, the friend who said she was “downsized” – these are all friendly terms for being fired. The truth is that if your employer has no reason to get rid of you, then you have a right to fight back.

In today’s difficult economy, Unfair Employment Dismissal has become more of a problem because employers find it advantageous to “fire” someone rather than “let them go”. By firing them, they don’t have to pay unemployment compensation, saving them plenty of money over a long period of time. So, many times, trumped up charges will be brought against an employee to warrant their firing, all to save the company money.

Because the employee is dismissed or fired, they often leave their employment wondering what is wrong with them, what they did wrong, or why they couldn’t accomplish the job, when in fact, the problem wasn’t with them at all. The psychological repercussions of being dismissed in this manner are long-term and can really devastate not only the employee but the entire family as well.

It is rare that employees are blindsided by an unfair employment dismissal. In reality, they see it coming but feel helpless against the will of the company. It usually begins by them being blamed for things they didn’t do, or being written up for minor infractions that other employees do every day. If you see these signs, make sure that you start documenting them immediately. You will need to be armed with every fact if and when you are fired. Of course, do not document them on your work computer – keep this information at home!

Unfair Employment Dismissal Summary

Once an employer has determined that you will be dismissed, it is hard to change their minds, and you probably wouldn’t want to if you could. Who wants to work in a place where they are not wanted? But, you can get retribution and you deserve to be compensated for the mistreatment. So, instead of hanging your head after being dismissed, remember that the problem wasn’t with you – that it was with your employer – and that you have the right to be treated like a human, and the good worker that you are. Don’t leave your pride behind at your last job. Take it with you to a new place of employment, one that appreciates you for who you are.
